1. Definitions
Your Travel Coach / Gobo Events will continue to be referred to as YTC
2. APPLICABILITY
The provisions of the agreement or these General Terms and Conditions. Copies of the General Terms and Conditions of the holders of the Locations or of the organizer are available on request from the holders of the relevant locations or from the organizer.
2.3 Accepting an offer or placing an order means that you accept the applicability of the General Terms and Conditions.
2.4 The provisions of these Terms and Conditions can only be deviated from in writing, in which case the other provisions will remain in full force.
2.5 All rights and claims, as stipulated in these General Terms and Conditions and in any further agreements for the benefit of YTC, are also stipulated for the benefit of intermediaries and other third parties engaged by YTC.
2.6 All offers from YTC and its partners are without obligation and are subject to availability.
2.7 Partners of YTC can act as mediators in the conclusion of the Agreement between the buyer and the Event Holder. These partners are not a party to the Agreement that is concluded through the purchase of (a) Ticket(s). The Agreement is concluded after the customer has purchased one or more Tickets through YTC or its partners.
2.8 YTC is entitled to check the data provided by the customer for accuracy. Providing incorrect or incomplete information may result in no agreement being concluded and/or the Tickets not being sent.
2.9 YTC is entitled to refuse orders or to attach certain conditions to the delivery, if necessary without stating reasons. The agreement is always concluded under the resolutory condition that YTC does not accept the order. If an order is not accepted, YTC will notify this in writing (by email) within 3 working days of receipt of the order
3. PRICES/OFFERS
3.1 All offers from YTC are without obligation and YTC expressly reserves the right to change prices, especially when this is necessary based on (legal) regulations.
3.2 All prices are stated in Euros including VAT.
3.3 In some cases there are promotional prices. These prices are valid for a certain period while supplies last. No claim can be made to these prices before or after the specified period.
3.4 YTC cannot be held to price statements that are obviously incorrect, for example as a result of obvious typographical or printing errors. No rights can be derived from unlawful price information.
3.5 You pay a fixed amount in booking service costs per ticket per order, which may vary per Event. The service costs consist of transaction, consultation and shipping costs.
3.6 YTC expressly reserves the right to change the prices of Tickets, especially when this is necessary based on (legal) regulations. In the event of limited availability of an offer, as soon as the offer is no longer available, YTC has the right to offer the same Tickets again at a higher price, without the customer being able to rely on the previous (lower) price.
3.7 Payment can be made in (one of) the method(s) indicated during the ordering process. Further (payment-order) conditions may be imposed on the order. In the event of technical malfunctions of any nature as a result of which (credit card) payments cannot be processed and/or authorized incorrectly or on time, YTC is not liable.
3.8 If the customer is in default of any payment, YTC is entitled to suspend the (execution of) the agreement.
3.9 Reversing behavior by YTC does not release the customer from his payment and purchase obligation.
3.10 If YTC has to incur (extra)judicial collection costs to collect the amount owed by the customer, these will be borne by the customer, with a minimum of twenty-five (35) euros.
4. USE OF TICKETS
4.1 YTC Tickets cannot be returned or exchanged and lose their validity upon expiry of the validity date indicated on them.
4.2 Tickets may not be folded or otherwise damaged. The customer bears the risk of this. In the event of damage, access may be refused and in that case the customer is not entitled to a refund or replacement.
4.3 Customers of Tickets must show them upon first request of the organizer, even after entering the Event. The organizer of the Event also has the right to ask for personal identification.
4.4 Tickets may not be resold unless the general terms and conditions of the Event organizer allow this. If this is permitted, YTC must immediately be informed of the personal details of the new owner of the relevant admission ticket in the event of resale.
4.5 It is prohibited to use Tickets for commercial purposes without obtaining written permission from the organizer of the YTC Event.
4.6 Each ticket has a unique barcode and can therefore only be used once. Copying ticket useless. Abuse will be reported.
5. CANCELLATION AND RETURN
5.1 An organizer has the right to move or cancel an event. If this happens, YTC will try to provide a suitable solution. If an event is canceled or postponed, YTC will do its best to notify you as soon as possible. However, we cannot guarantee that you will be informed before the start of the event and we are not responsible for any costs incurred.
5.2 Before confirming your reservation, always check carefully whether you have reserved the correct tickets. YTC is not obliged to take back or exchange tickets once sold.
5.3 YTC is not liable for compensation or refund of entrance fees in the event of cancellation of an event by the Organizer or the holder of the Location. If and insofar as the organizer decides to refund entrance fees and the organizer engages YTC for this purpose, reimbursement of entrance fees that have demonstrably been paid to YTC can take place via YTC.
5.4 YTC will under no circumstances be obliged to reimburse more than the entrance fees. This means, among other things, that any additional costs that the Client has paid for the services provided by the organizer or on behalf of the organizer by YTC, such as reservation costs, will never be reimbursed.
6. PAYMENTS
YTC accepts iDEAL, Credit Card and Paypal payments. Only once the payment has been approved will you receive confirmation that your order is final.
7. DELIVERY
7.1 The tickets will be delivered as a PDF by e-mail immediately after receipt of the order. After payment, tickets are also presented as a PDF document on the customer’s computer screen. The Customer must print this PDF document himself and take it with him to the Event.
7.2 The delivery times stated by YTC are only indicative. Exceeding any delivery period does not entitle you to compensation or the right to cancel your order or terminate the agreement, unless the exceeding of the delivery period is such that you cannot reasonably be expected to maintain the agreement. In that case, you are entitled to cancel the order or terminate the agreement to the extent necessary.
8. RETENTION OF TITLE
Ownership of delivered tickets will only be transferred if you have paid all that you owe to YTC under any agreement. The risk regarding the tickets passes to you at the time of delivery.
9. COMPLAINTS AND LIABILITY
9.1 You have the obligation to examine upon delivery whether the tickets comply with the agreement. If this is not the case, you must notify YTC of this in writing and with reasons as soon as possible and in any case within three (3) days after delivery, or at least after observation was reasonably possible.
9.2 If it has been demonstrated that the tickets do not comply with the agreement, YTC has the choice to replace the tickets in question with new tickets upon return or to refund the amount paid.
9.3 YTC is not responsible and does not provide any guarantee for (the access to) the Event, for the organization of the event, for the (artistic) quality and content of the event, nor for the course of events in and around the Location and accepts no liability in this regard.
9.4 YTC can never be held liable for damage resulting from death, injury, accidents, injury, loss, damage or theft caused to the Client during or as a result of a visit to the event or location.
10. ELECTRONIC COMMUNICATION AND EVIDENCE
10.1 YTC is liable for misunderstandings, mutilations, delays or improper transmission of data and messages as a result of the use of the internet or any other means of communication in traffic between the customer and YTC (or third parties engaged by the customer). .
10.2 YTC’s administration serves as complete proof of the existence, content and execution of the agreement with the customer in any legal proceedings, until proof to the contrary by the party that relies on the fact that the evidence is not reliable.
11. FORCE MAJEURE
11.1 Without prejudice to its other rights, in the event of force majeure, YTC has the right, at its own discretion, to suspend the execution of your order or to terminate the agreement without judicial intervention, by notifying you in writing. sharing and this without YTC being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.
11.2 Force majeure means any shortcoming that cannot be attributed to YTC, because it is not its fault and is not its responsibility under the law, legal act or generally accepted views.
12. SPECIAL PROVISIONS, LIABILITY
12.1. The buyer of a ticket supplied by YTC must behave as a good and orderly visitor to events and adhere to instructions given by or on behalf of the organizer of an event to be visited by him as well as by the competent authority.12.2 YTC will not be liable for a refusal by event organizers or public authorities to admit the buyer of a ticket supplied by YTC to an event due to actions and/or omissions by the buyer.
12.3 The buyer of a ticket visits an event at his own risk. YTC will not be liable for damage incurred by the buyer while traveling to or from the event or attending it.
12.4 The buyer of a ticket supplied by YTC must inform himself of instructions given by or on behalf of the organizer of the event or the competent authority, as well as of changes relating to the event, such as starting time and the like. YTC is under no obligation to inform the buyer of a ticket in this regard.
13. MISCELLANEOUS
If one or more of the provisions of these terms and conditions or any other agreement with YTC are in conflict with any applicable legal provision, the provision in question will lapse and will be replaced by a new legally permissible provision to be determined by YTC. similar provision.
